Legal Question in Family Law in Maryland

Terminate parental rights

My son's father has'nt seen him since he was 1 and now is 5. He was paying child support until he was sent to federal prison 2 years ago, but is soon to be released. I would like to know if it's possible to end any rights he has towards his son,and have them never reinstated again.

Re: Terminate parental rights

A termination of parental rights is very difficult to get unless the parent is a terrible parent who is likely to pose some real harm to the child. You don't say what the offense was that sent your son's father to prison for two years. If it was some kind of child abuse or sex offense, that might be enough to convince a judge to terminate parental rights. But most crimes are not enough. Most often a termination of parental rights is sought by Social Services after a period of trying to work with the parent to help[ him, or her, become an acceptable parent. I really don't have enough information here to tell you whether you might be successful in terminating the father's rights, but you should consult with an attorney and give the attorney all of the details.
