First of all, if you file a timely answer contesting the motion, it's not ex parte. Your response should be filed within 15 days if it's a motion in an existing case, unless what they filed was a petition for a show cause order accusing you of violating an existing order. In that case the order for show cause tells you when your answer is due. You must admit or deny the factual allegations contained in the motion/petition and explain why it wouldn't be in the child's best interests to deny you shared custody. You really should seek a consultation with a lawyer who practices family law who can review the motion. If you don't currently have representation you can get an inexpensive consultation through your county bar association's lawyer referral program.
