Legal Question in Medical Leave in Maryland

child support & medical bills

For the last year and a half I've been paying child support and all medical bills for my son while he was living with me or in rehab for addiction. My ex is the custodial parent and acording to are agreement meical bills are to be split 50/50. I filled a motion for modification of child support and a hearing is set. What are the chances of getting financial relief for medical expenses paid and child support paid while me son wasn't living with ex?

You should receive child support if your minor child is living with you and depending on what wife's income is. It is less clear for when he was in rehab.. Technically, if she has custody through the court, and is receiving support, she is responisble for the 1st $250 per year of his medical expenses, and then it is divided proportionately as should be set forth in your order. You may also need to change the custody order to have it reflect that your child resides with you.
