Legal Question in Medical Leave in Maryland

Pregnant and on disability, will I have a job?

I have been placed on medically nessesary bedrest for the remainder of my pregnancy approx. 14 weeks. I am concerned because my employer has notified me that because of the length of my absence he will be replacing me with a new executive. What are my legal options at this time? Must my employer keep my job available for my return? My company has leave of absence policies as well as maternty benefits. 26 weeks paid leave and 10 weeks maternity. Can he legally replace me since I've only been gone 1 week to date?

Family Medical Leave Act/Pregnancy Discrimination Act

You can always be replaced but if so the employer must pay a price. You have definite rights per the Family Medical Leave Act such receiving a percentage of pay while off,reservation of job and benefits and certain rights per the Pregnancy Discrimination Act I would suggest you contact an attorney in your area who has experience in this area
