Legal Question in Civil Litigation in Maryland

Addresses for Defendants

Hello, I am a pro se plantiff completing an original civil complaint form in which there are multiple liable agents listed who are employees of the defendant. Since the defendant has a Resident Agent address, do I use it or the defendant's address on the original complaint form? Likewise, should I use each employee's home address when completing their individual copy? Your response would be greatly appreciated as soon as possible.

Thank you,

LilG

Re: Addresses for Defendants

Based on your question there appear to be several defendants. It may or may not be advantageous to file suit upon each or all of them.

Many matters bring a case outside of the use of forms that may be available online or elsewhere. There is no substitute for a the representation of an attorney.

Typically a resident agent is served where the company is the alleged wrong-doer. Suing employees can be a viable approach but you keep a view on the overall case and respective obligations/liabilities of each party. Suing employees just for the sake of doing so is NOT a suggested practice. Costs may be assigned as a result of abusive or otherwise non-meritorious filings. More important is that you may give up on tactical matters.

Consult an attorney.

Re: Addresses for Defendants

Proper form when suing a corporation is as follows:

ABC Corp.

(address)

Serve: John Jones, Resident Agent

(address)

Individual defendants should be named and their home or, if unavailable, their business addresses, should be listed in the complaint heading.
