my buddy went to jail and his vehicle is in repossession. but the dealership refuses to come get it for over 5 weeks now. when can i claim it as an abandoned vehicle?

I don't think it would be considered abandoned under these circumstances, since your buddy is being prevented from taking possession of his vehicle because of his incarceration. I don't know what you mean by "in repossession". Repossession is the act of taking the vehicle from the delinquent borrower/owner by the lender. Also, the lender is probably not the dealership, but a loan company that finances vehicles through the dealership. They are probably named on the title as a lienholder, and your buddy should have some paperwork identifying them.

If you really want the vehicle and your buddy is willing to either give or sell it to you, you could try and work out a deal with the lienholder wherein they assign their interest to you and release the vehicle from their lien.
