Legal Question in Civil Litigation in Maryland

False Property Claims vs. Unpaid Child Support

My father is trying to falsely sue my mother for money he claims she owes him. He has a whole slew of lies on the served papers and plenty of people that he'll pay to lie for him. However, he never paid a cent of child support to my mother in the 24 years I've been alive, despite her attempting to take him to court 3 times. He has two peace orders against him from my mother, and we have had to call the police on him on three different occasions. Does he have a leg to stand on here? We're very worried. Thank you.

Re: False Property Claims vs. Unpaid Child Support

It's impossible to analyze the merits of your father's claim without knowing more of the facts. Generally speaking, if your father is solely relying on testimony, as opposed to documentation, to prove your mother owes him money, the courts will give less credence to his claim. But if you and your mother feel you have some exposure, you ought to at least schedule a consultation with an attorney. You can provide the attorney with the court papers to review, and he/she will be able to get information from you that will enable him/her to give you a more precise evaluation of the most likely outcome. If you retain the attorney to represent you, he/she can properly prepare the defense to give your mother the best chance of success.
