IN any civil case, where the conduct of the wrongdoer is so outrageous and malicious (an extremely difficult thing to prove in Md)., yes. Very rarely do plaintiffs overcome the burden of proof to justify "punitives". If you are talking garden variety negligence, even recklesssness, and the conduct is not so unique, the court feels it is not justified in imposing "exemplary" type damages to deter such actions.
