Question Re: Garnishment

Hello,

I have a question regarding garnishment. I have a judgment against my husband and me for $1092.00. The garnishment began two pay periods ago (on me only) and so far the law office has rec�d $482.00. Today, my husband found out that his pay is also going to be garnished. Can they garnish both of our pays if we�re married? And how do we prevent them from taking too much? Should we object to my husband�s garnishment or try to recoup the overage after it�s all over?

They can garnish both paychecks since you are both named in the judgment. The amount is limited to 25% of take home pay. Since they are garnishing simultaneously, there's a danger of overlap since one employer won't know how much has been taken out from the other's paycheck. I suggest you contact the law firm doing the collecting and find out how they're going to handle this.
