''Removing owner from home''

My sister has had to file for bankruptcy because her husband has been using drugs. How can she get him out of the house or at least make him pay the mortgage so that she and the kids are not on the street? He refuses to go into a treatment program and she is unable to maintain the house on her salary. Thank you.

Removing the husband from the home isn't going to solve the real problem, which is getting him to support the family by contributing to the mortgage payment. Assuming he's working, since if he has no income, there's no ready source of payment, your sister needs to get a child support order against him and then serve it on the husband's employer. The employer will then be required to deduct the amount due from each paycheck and send it to your sister. She should contact the office of child support enforcement in her county for assistance.
