Legal Question in Civil Litigation in Maryland

Reprinting painting of minor without permission

A neighbor painted a picture of my son (3 years old) last year and now it is hanging in the local packaging and mailing store as a greeting card. I was never asked about this and never gave any permission, I feel it is threatening the safety of my son. Is there anything I can do about this legally?

thank you

Assuming the neighbor and the store won't agree to remove it, you could seek injunctive relief in court. You would ask the court to order store to remove the items from its product line and deliver the product to you. You will probably have to post a bond covering the expenses that the defendants could incur if you're unsuccessful. You would argue this is a violation of your child's privacy and is commercial exploitation of your family.
