Legal Question in Civil Litigation in Maryland

tresspassing

My neighbor stays on the street but allows her dog to come on my property to use it as toilet. I have on three separate occasions told her to stop. What can I do?

Tell your neighbor that if she doesn't have the courtesy to control her dog, you'll be "returning" the deposit to her in a location she might not enjoy. Technically this could be considered a nuisance or property damage, but it's really not something worthy of court action.

First, you might contact the animal control officer (or equivalent) for your town. This is probably a violation of a local ordinance and the officer might be willing to issue a citation. You might also report the situation to the police and file a complaint for littering, trespassing, "pooper scooper" ordinance, etc. The owner should be issued a summons to appear in court.

You could file a small-claims suit in civil court as well. Consult an attorney.
