Legal Question in Immigration Law in Maryland

TN-1 extension question

I'm living in Maryland studying to take the Maryland bar exam. I am a licensed attorney in Tennessee and my TN-1 visa with my former employer in Tennessee is still valid until July 4th. I am getting married to an American on June 5th. I just received a job offer from a firm in Maryland. THey want me to start immediately at an hourly rate about 15 hours a week until I take the bar exam and then full time. Should I work for no pay now and send away for a TN-1 visa extension by mail? I don't have any time to travel up to Canada right now. How long is the wait for an extension by mail? Is the extension only if its the same employer? Should I wait untl after the bar and make a trip to Canada to get the TN-1, is this the easiest and more efficient way? Or should I send the extension by mail and if I don't receive it back before I take the bar, take a trip to Canada after the bar? Is it an issue that when I apply for the TN-1 for the job in Maryland I won't yet be licensed in Maryland (just taken bar) but have all other required licenses, degrees and a license in TN?

Re: TN-1 extension question

You have a lot of choices. I go to the ports of entry for TN's often and since you are not licensed yet in MD, you will encounter difficulties getting the TN issued to you. They are taking 5-6 months to process TN's at the Service center. This may solve some of your issues in terms of maintaining your status. Remember, a TN only allows you to have nonimmigrant intent. You should consult with an attorney to strategize to ensure you are covering all your bases. Good luck!

I would actually recommend another course of action and visa option. Feel free to call the office for a free consultation to discuss your options and explore the TN visa as an alternative.
