Unisured Motorists Insurance

While living in MD I was walking across the street and was hit by a motorist who I eventually found out did not have any insurance. I was taken to the hospital via ambulance and had a police report filled out. The insurance agency for the motorists said since the person did not pay his insurance and was in the process of filing bankruptcy I had no recourse. Is there someone I can sure for my injuries and medical expenses? I was told that I can get reimbursed from the state of MD for uninsured motorist claim... is that correct? If so, do I need an attorney and what is the statute of limitation for making this claim? Thank you.
