Can I use the lawyer's address to file for my trademark application? I want to remain as anonymous as possible!

Re: Trademark questions

How about you have the lawyer file the trademark application for you?

As Mr. Press correctly noted, trademark registration and anonymity are inconsistant. An attorney can evaluate all your facts and advise you of some options. One option that readily comes to mind is establishing a holding company to own the trademark.

One big CAUTION here: falsifying information on that trademark application is a crime. It concerns me that you didn't ask what owner name you can list but only the owner's address? It makes me go down a very slippery path thinking you may be filing a fraudulent trademark application. That would never be okay, and your ignorance of the law will NEVER be an excuse.

Please consult your own attorney in this matter.

Re: Trademark questions

Unless it is the registered office of the corporate aplicant where a mark owner has no other fixed place of business, no. Amyway, anonymity and trademarks do not seem to be particuarly consistent, as the purpose of a mark is to associate the goods/services with the mark's owner.

Re: Trademark questions

One possibility to consider in filing an application for federal trademark registration while avoiding disclosure of a named individual is to establish a LLC (limited liability corporation) through the Maryland Secretary of State. In this manner, the LLC could possibly be listed as the federal trademark applicant with the USPTO (United States Patent and Trademark Office). Applicants must carefully consider their actions, of course, to ensure that they are not taking any steps that would constitute fraudulent behavior upon the USPTO.
