Legal Question in Employment Law in Maryland

Me and my dad just started a transportation business. He drives tractor trailers and I invested half of the money for the truck. As a result he has been putting $300-$500 a week in my bank account and will continue to until we have enough to buy another truck.Can I legally accept that money as an independent contractor?
