termination after auto accident

my stepson was in an auto accident he was not at fault, [non-work related]and has been off work due to injuries, his employer is now adviseing him that if he doesn't come back to work that he will be fired. my stepson has not been medically released back to work. he has been off work for 6 + weeks, his employer stated that the law had changed and that there was nothing preventing him from letting him go. is this legal/correct?

In determining whether the Family Medical Leave Act applies, it would be helpful to know the length of time your stepson was employed and the size of the employer in terms of the number of employees located near where your stepson worked.
