Landlord Won't Return Security Deposit

I vacated my apartment on 11/22/2004 and during the final walk through my landlord commented on how clean the apartment was and said she would not even need to hire someone to clean it. She said she would return my security deposit within 30 days. 30 days passed and I did not receive anything from her. I left her many messages and finally on January 11th she called me back and blaimed her accountant and told me that I would be getting my deposit back. It is 3 weeks later and I still don't have my check and she does not return my calls. What are my rights?

Under the Real Property Statutes the landlord has 45 days after termination of the lease to return your deposit with interest. Failure to comply with the statute may result in treble damages i.e. three times the amount of the security amount.
