Police responsibility

My daughter slipped and fell in a home rental apartment where she was living for 3 months. The home owners family was well known and the police immediately closed the case. When I asked them to reopen they refused saying it was just an awful accident. Do they have the legal right to refuse to reopen the case?

I have to admit that the question confuses me. A slip and fall is, almost by definition, an accident. I don't know why the police would be involved at all. If someone committed a crime and pushed her down, for example, then I can understand why you would expect police assistance. But absent some sort of intentional conduct - that is, absent someone purposely injuring your daughter - this is simply not a police matter.

It is, however, an insurance matter if your daughter was injured and required medical treatment. The homeowner's insurance police may well cover this sort of incident. If you and your daughter would like assistance in setting up an insurance claim, please don't hesitate to contact my office.
