Legal Question in Legal Malpractice in Maryland

completed and paid for bankruptcy not filed, 13 months

I went to an attorney and filled out the paperwork paid for it, signed it,in December of 1998. As of March,2000 the attorney's still have not filed my bankruptcy report with the court!!!!Excuses consisted of, paralegals leaving and attorney didn't know it wasn't filed (approximately 3 times) Each new paralegal called me to make changes, (they didn't understand what they're predicessor had done or didn't understand the paperwork in front of them) Can't find it was one of the responses, Anyway, I want this taken care of because the turmoil and anxiety are making me ill. Phone calls are seldom responded to even when requested. What recourse do I have? How do I get them to file what I paid for that long ago?

If this is really the case, it seems to me you need to get a new lawyer, who can demand that the former lawyer refund the fee. If the former lawyer refuses, report him to the bar. There mnay be reasons to wait before filing, but your lawyer should explain them to you.
