Legal Question in Medical Malpractice in Maryland

I had surgery a couple years ago and the surgeon used permanent staples to close my bladder after removing a cyst. Now I have clusters of stones formed across the suture line. I was told by a urologist permanent sutures are contraindicated for bladder surgery for this reason. I have passed two stones with staples embedded in them. I have to get the rest lasered off before they cause more problems. Once the stones are gone the staples will continue to form stones the rest of my life. I have to periodically get checked and have procedures to get rid of them. Is this medical malpractice since the surgeon should have used absorbable sutures?
