Legal Question in Personal Injury in Maryland

Accident Involving Uninsured Motorists

I was recently involved in an accident (major damage to both)and found out my insurance had lapsed. The other party did not provide insurance info. to me and he had stated he was a City Police officer. We did not file a report (nor did he give me his ins. info, and 2 calls to him have not produced this either). Should I just have my own car repaired and let this go, since I am at fault also, or hire an attorney in case he should seek damages?

Re: Accident Involving Uninsured Motorists

If you were at fault, even in the smallest amount, you cannot recover from the other driver. You should fix your own car and hope he doesn't sue you (he has no claim against you if he was also at fault). Don't bother retaining counsel unless he asserts a claim against you. But don't say anything to anyone (other than a lawyer retained by you) about being at fault, or the details of the accident.
