Legal Question in Personal Injury in Maryland

auto accident with minor

Can I, sue for time loss from work. I was in a car accident in Dec 2004 myself and my daughter who is a minor.

When I, spoke to the insurance company they said I, was not cover under that person policy. They said the person driving the vehicle is not cover. So I had to pay my own medical bills and use my sick leave from my job which I, had to be off from work for 30 days. Then my daughter was off from school for 3 days plus some follow-up. She has not been abe to go to practice for the pom pom team since the accident and have not been abe to drive since the accident which I, have to take her to school every day. Will I, be paid for the medical bill that she has becuase my health insurance paid the bills. Do they have to give me the money that was billed by my insurance company. And if they want to give me a steetment for my daughter want can i ask for. And how do I, get paid for the time I, loss from work.

You and your child have a right to be compensated for the losses and damages you describe to the maximum extent of the law (even if you have health insurance). These things are frankly too complicated to handle on your own, without a lawyer. There are time deadlines and notices which you would not know about. For example, in MD, if you are a passenger in an uninsured vehicle (not the driver) you may be able to file a claim with MAIF for UM coverage. I believe the notice time is 180 days from the accident date. Time is of the essence. If the other car was at fault, you have insurance coverage there and need to make an effective and proper claim with them and sue in time if a satisfactory settlement cannot be reached. If you own a vehicle, you may also be able to file for benefits through you own insurance coverage (PIP/UM/UIM, etc.) You need a PI lawyer. My telephone number is (301) 279-8773. Essential to your question is the matter of fault (i.e., who caused the collision?) From your question I infer that you were not at fault. If this is the case then you need to take prompt action.

Whether the other driver was insured or not is secondary to your financial recovery and settlement.

Seek legal assistance for resolution of medical bills and other matters associated with automobile collision claims involving personal injury.

You can bring a claim against the other driver, if that driver was at fault in the accident, for injuries for you and your daughter. That claim should include a claim for medical bills and pain and suffering for both of you, and a claim for lost wages for you. Your recovery should include all bills, even if your health insurance company paid those bills.
