Unfortunately, I don't know of any way that you can be compensated for your trouble. If they had refused to pay you at all, or to deal with you at all, there are things that could be done. I am sorry you had a difficult time; unfortunately, this is the way some insurance companies act.

Re: Compensation from the other parties insurance agent

If you have not signed a release, please contact a lawyer immediately. The fee the lawyer charges (usually 1/3 of amount recoverd) is certainly less than the aggravation the insurance company will cause you in dealing with them. You have numerous rights in a motor vechile accident (if the other person was at fault) and a lawyer can best explain them too you. You may contact my office if you wish at 410-828-9363 for a free consultation.

You cannot sue or claim damages for the aggravation in dealing with the other driver's insurance company. That is only one of the reasons that it is better to get a lawyer. If you did not sign a release, you may still have a claim - if you only got the damages to the car, the rental car, and your medical bills paid, you certainly did not recover all that you are entitled to (provided the other driver is at fault). Contact a lawyer immediately.
