Legal Question in Personal Injury in Maryland

My Daughter's car was registered by me. After some time, the car broke down and it can not be repaired. I told her to returned the tag to MVA and I cancel the auto insurance. Unfortunately She did not and she did not told me. She put the tag into another car and she got to an accident. I did not know any thing about this accident. I traveled to Africa and stay their for 4 month. Court date was sent. I was still in africa at that time and the judgement was pass against me that I did not come to court. When I came back I got a letter from MVA that my drivers license was suspended and my personal car tag.

If the car that caused the accident was not titled in your name, you wouldn't be legally responsible, despite your tags being on it. Even if it was your car, since you weren't driving only your daughter would be responsible. You need to immediately hire an attorney and file a motion to have the court judgment set aside. Hopefully it hasn't been more than 30 days since it was entered; if you wait too long it's much more difficult. I must say that in order to get jurisdiction over you in the suit the complaint filed by the accident victim would have had to have been served on you to give you notice of the suit, which means someone who lives with you would have had to receive it either be certified mail or a process server. Shame on them for not letting you know about it right away so that you could protect yourself, even while in Africa.
