Can I sue my insurance compnay and is te other party at fault?

Can I sue my insurance co.? A cab came onto the parkway from a ramp that has no merge area, but a yield sign, he did not yield and pulled in front of me. The conditions were rainy, and I put my brakes on to avoid hitting the cab. My car locked spun around and a car hit me. In the event, the police said that my license was suspended from parking ticket, which I did not know about, and immediately took care of it that day. The insurance said that they knew but did not inform me, and was not there responsibility to inform me, however I renewed my insurance 1 month before the accident, and on the renewal it does not say that I'm listed as an "excluded driver"; however, the insurance says that I'm listed as a "excluded driver", and in the event that they do not find the cab at fault , I will be personally responsible for all damages. What can I do? Do I have a case? Can I sue the insurance co.? Shouldn't the cab be charged since he caused the accident?

Personal injury-Phantom Cab

It seems as if the cab is responable, because it's primary neglegence set in action a chain of events that caused harm to you. Of course Your insurance company will have to be forced (sued) to cover the damages, Under the uninsured moterest provision of the policy if the phantom cab driver can't be found.
