Wind Chimes Disturbing Peace

What can be done about neighbors who refuse to take down wind chimes that are waking us up at night? We have asked them once, and were told that they would take care of it; called once, at night and left a message; and sent a certified letter concerning this issue. The police will not come out for wind chimes that are disturbing the peace.

Technically, you could sue them claiming nuisance, but I doubt your suit would be successful unless you could establish that these chimes were not typical of the noise usually made by chimes, or that there was something unique about the relative locations of the properties that made the noise unacceptably loud. From a practical standpoint, it would be better to try and sit down with them and discuss it in a friendly way. Maybe if you tape recorded the noise from your bedroom they would appreciate how it could be disturbing your sleep.
