Legal Question in Real Estate Law in Maryland

adding a spouse to the deed of a home

My husband and I bought a home a few months ago, We went VA since my husband was previously a marine. Because of this my name was not put on the mortgage and it was overlooked by the title company and rather than reschedule settlement date, we went ahead with the purchase. How do we go about adding my name to the deed. If anything were to happen to my husband, as his wife would I be automatically be entitled to the home without my name on the deed, or should we go ahead and have my name added. If so what is the charge to have a name added to a deed?

Re: adding a spouse to the deed of a home

It's a simple matter to add your name to the deed. Once your name is on the deed, the property automatically becomes yours if your husband dies. Otherwise, it would go through a probate proceeding and go to whomever he leaves it in his will, or if he has no will, by MD law. I could prepare a new need at a cost of $150 for my services. There would also be some modest recording fees imposed by your county recorder's office.
