Buyer backs out

Our buyer backed out because the title had the property listed as 28,000 square feet, which is .66 of an acre (but it is really .28000 of an acre or about 1/4 of an acre). It was an input error by the County.

The contract mentions nothing about the lot size and the buyer walked the property a month ago with no problems.

Can they do that?

If the buyer walked the property before the contract was signed, it would depend on what the sales contract said, if anything, about the lot size. Generally if you didn't affirmatively misrepresent the lot size and the legal description of what was conveyed was accurate, the buyer would be bound to the contract.
