Legal Question in Real Estate Law in Maryland

Under what circumstances may a Wrongful Detainer (TITLE 14 - Subtitle 1 Section 14-132 of the Maryland Real Property Code) be filed in terms of house guest? The guest in question does not stay at the rented residence on a regular basis, and the roommate does not wish for the guest to leave.

It depends on the provisions of the tenant's lease. If they are entitled through the lease to have occasional guests or if the lease allows 2 occupants, and the guest is the second occupant (or otherwise within the lease limit), then there would be no basis for a detainer action.
