condo dues

If a person is in arrearage of their condo fees (over a year) and refuses to pay these dues but is renting their condo for over $2000 per week, can the board have her electricity disconnected since the meters and circuit breakers are owned and maintained by the condo association. She has been in and out forclosure and bankruptcy. Seems she knows the system.

I'd sue, get a judgment, then attach the $2,000/wk. rent (I asume this is a summer rental) until she is paid up. I believe the Sheriff will go to the house and tell the renters to pay the money to the court, and if they pre-pay (likely), you will need to be more aggressive. I'm not sure how MD handles this situation, but you can probably ask for a reciever be appointed for any money collected, and the reciever will distribute the money collected. If they continue to not pay, record your judgment, get an atty yo file in Small Claims Court every 1-2 months to get ongoing judgments, unless the judge will give an order in equity for monthly payments to the association. Then you file for foreclosure. The deadbeat should be liable for any and all costs necessary to compell payment, so do what you need to. One of two things will happen, 1) you sell the unit and the problem goes away, or 2) she stops screwing the association and pays, because when she does not, you screw back, and she has to pay you to go after her.
