Real property in VA does not pass through the probate estate unless the will provides that it does. So either the will is recorded and that transfers title, or if there is no will it passes automatically and is noted in land records by filing a Declaration of Heirs. See a Virginia lawyer to advise you on this. It can be particularly difficult if this was not done for multiple generations.
