Legal Question in Real Estate Law in Maryland

lost mortgage documents & mortgage not recorded - I have the same situation as a prior person but my mortgage (fha) has gone into default and I've been contacted by an attorney of the mortgage company stating that the closing documents have either been destroyed or misplaced. I have not paid my mortgage for over a year and not sure how to proceed. I know that I need legal help but unsure who to contact.

Fist you need to decide whether you intend on keeping your home or whether it is time to sell or work with the bank on a potential short sale or cash for keys. You need contact the foreclosure attorneys' to confirm the status of your loan. If the bank never recorded your deed of trust (mortgage) then the bank may file a declaratory action in circuit court to enforce it. You need an attorney to work with the bank to either negotiate a forebearance agreement, loan modification or agree to sign a new deed of trust in lieu of the litigation and negotiate a sum of money that can be used for moving.
