What remedy does a tenant have against a meritless suit for damages?

If you've successfully defended the suit, and you've incurred expenses in doing so, there is a rule that allows you to seek recovery of those expenses if you can demonstrate that the suit was filed in bad faith or without substantial justification. However, judges are quite reluctant to grant such requests as long as there was some arguable basis for bringing the case to court.
