Which power of attorney form to use.

Refinancing Home - husband out of town - need power of attorney form giving me authority to sign his name for the settlement because it was postponed from original settlement date. I am unsure of which power of attorney form to use since it is for a refinance versus a purchase or selling of a home.

Ask your settlement attorney or title company that is handling your closing to prepare the power of attorney. They should know exactly what to do.

In the case where the lender is selected, a personal guarantee effected directly with the lender by your husband may suffice. Contact them on this matter.

Otherwise a general power of attorney with a specific powers clause should be sufficient. A lender may require that he personally sign a mortgage at a subsequent date.
