putting home and p[roperty in sons name

i am separated- unemployeed- filed for disabiltiy- have no income- the mortgage is in both mine & husbands name- he has disappeared- will not return calls-i dont know where he lives- etc. can i somehow have my sons name put on property incase something happens to me???? husband has not paid mortgage for aqlmost 4 years or any other household bills-son has been paying mortgage & other bills-property taxes -etc. husband has breached separation agrteementon money to be paid- i dont have funds to take him to court!

The first thing yo should do is contact the bar association in your county and try to get a referral to their pro bono program if they have one. This program supplies free attorneys to income-qualified people. If you don't qualify for a pro bono lawyer, you may be eligible for a reduced fee attorney.

You cannot add anyone's name to your deed, nor can you remove your husband's name without his agreeement and signature. Since he's disappeared, that's a problem. Therefore, you must go through the court system. An experienced family law attorney can advise you on what legal procedures are available to you.
