Real Estate sales losses

Situation:

I had a property for sale and had people coming to the property (potential buyers).

One of my neighbors who lives across the street, doesn't want the property sold and stated to the potential buyers that the property ''was not for sale'' when they came up in the yard to see the house as told to me by my other neighbor who heard them tell this.

Question:

A restraining order won't work as she can yell from across the street. I'm not sure how many people she turned away but red flags went up when the property didn't sell in a hot area... But, my quesiton is, what can I do legally for damages that I've had (from potential sales-loss)? Also, this person uses (and goes into) my mailbox without permission, what can I do about that?

I would write a letter to the intruding neighbor (or have an attorney do so) advising her to cease her activity or you will consider legal action for tortious interference with contract. I suggest you post a for sale sign on the property if you haven't already done so, so that interested parties won't be dissuaded from inquiring by her comments. As far as the mailbox goes, that's a criminal violation and if you catch her doing it, you can press charges.

What evidence do you have that this individual is the cause for your house not selling? Are you sure that your area is still hot? There may be other superseding factors that are impacting the sale of your home i.e. price of the home, income of potential buyers, inability to get financing. Why would any potential buyer listen to a neighbor across the street regarding the sale of a home when there is a sign in the yard saying "For Sale."

You should take immediate action as this situation may be very costly in the end. It is a civil wrong for someone to mess around with another person's economic activities. This wrong can be address through several actions, most notable is tortious interference with business activity. Rather than taking full blown action a letter from an attorney may obtain the desired result.

Call a postal inspector and make a complaint concerning the mail issue. This is a federal crime and such behavior cannot be tolerated.
