Sharing a home

Hi, A friend and my wife and I are looking to buy a condo together. Do you know of any existing documents that we could use to guide us to develop an agreement? Just incase something happens down the road we want to protect ourselves. Thanks

I don't know of any magic documents which will make all of your problems go away, but it would help to have a conversation about your concerns, agree on the outcome of any particular stalemate,reduce it to a writing, and sign this document. It won't help with every problem, but at least you've communicated and have a written agreement.

A particular problem with partners owning property often involves two parties who each own 50% and if one party disagrees, there's a complete stalemate and inaction, unless one party files in court for partition. Disagreements often concern the decision to sell or not, how much each party should be allowed to use and/or should contribute to upkeep, and who bears insurance-type liability for the property.

Your real estate agent, real estate attorney, and even possibly your settlement agent may be good sources of advice on this matter.
