Sublessor Files Bankruptcy

The Landlord has notified subtenant that sublessor has filed bankruptcy and the LL wants rents check mailed directly to him from subtenant. What information do one request from the sublessor, how can this matter be resovlved and is a new lease agreement required?

The filing of bankrutpcy does not always terminate the relationship of the lanlord and its tenant - your sublessor. If you paid the landlord directly, the bankrutcy trustee may make claim for your rent due under the sublease. Tell the landlord that you need to speak with the bankruptcy trustee. Tell the bankruptcy trustee what the landlord wants you to do and get his agreement. If he agrees, then you can make payment directly to the landlord (only to the amount of the sublessor's rent) with the balance to the bankruptcy trustee. If the trustee refuses you should get a lawyer to assist you.
