water in basement

we have lived in our present home for =21 years, never having any water problems in our basement. Late last year, 40 homes were built in a wooded area behind our house. We are now getting water in the basement. The land was on wetlands and they filled them in, we were told that no wetlands were allowed to be filled in, but it was done anyway. Is there any legal action we can take against the builder? Thank you.

You will have to find out much more about the project, including how the developer obtained approval to build on the wetland area, the method it used to fill in the wetlands, whether it was required to protect adjoining landowners such as you etc. The first step is to find a qualified person to inspect the property and the area and advise you if the new development is the cause of your problem. From a historical perspective, it appears to be, but you will have to be able to prove this if you go to court.

The inspector might also be able to explain why the development is causing your problem. This will help you determine if something was done improperly during the construction process, and therefore is legal action is justified. Good luck!
