fired for sexual harrassment

I was fired from my job as a district manager for sexual harrassment. i had an affair wiht someone of the same sex who worked for me through a temporary service. When things ended, she turned things around said i was sexually harrassing her and i was suspended from work for 3 days for investigation. As it turns out, she had kept text messages on her cell phone from me, and of course i always deleted my text messages from her and had no proof that it was consensual. i ended up getting fired. Is there anything i can do about this? I haven't even tryed to go for unemployment. This happened in November.

You asked about sexual harassment.

Unfortunately you probably have few options open to you at this late date. Most claims for wrongful termination must be brought against and employer within 6 months of the adverse action.

There may be factors to your specific situation such as the specific laws that you may file under which alter that suggestion. But also, the situation probably falls under an at-will-employment situation. An employer can fire an employee for any reason that is not discriminatory. And you did have a relationship with a person that was your subordinate. It's not as if you didn't know you were exposed to a claim of misconduct.

In any case, you should file for unemployment immediately. That has no bearing on any claim and even if the company denies the claim the length of time out of work exceeds the denial exception period.

You may have a defamation claim against the complaining worker. But you would need to produce proof.
