Legal Question in Telecomm Law in Maryland

Use of a tapped message against another

A women that I had an affair with is threatning to send messages that I left on her answering machine to my place of work. The messages were telling her to get out of my life, they were rude and vulger..a reflection of how she has talked to me. I talked to her the next day and appologized for being so rude and I would stay out of her life. She said she would send the messages to my work to burn me. She was really offended by some of the comments I made on the tape.

Is this legal for her to do? I knew my messages were being tapped, but they were intended for her only. Would she need my permission to send the tapes out?

Re: Use of a tapped message against another

The messages were meant only for her to hear with a pretty clear expectation of privacy that they would not be sent anywhere else. Assuming there is nothing about your job mentioned in the messages, there is no reason to send them there. Possible torts she would be committing are invasion of privacy and intentional infliction of emotional distress. You might write a letter to her telling her that the messages were clearly not meant for anyone else but her, and you do not give permission for them to be sent to anyone else, and request that they be erased. Good luck.
