What is Equitable property?

If my father gets married to his live in girlfriend of 10 years, what is she entitled to upon his death by marriage? What is there's a Will stating that his estate is divided among his children?

There are two method where a wife may take from a husband's estate. A wife may take under the Last Will and Testament or she may take under an elective share which is otherwise known as an election against the will. You should also understand that certain property may not be subject to the Last Will and Testament because it has been designated to a beneficiary through another legal document.
