Legal Question in Wills and Trusts in Maryland

Modifying a trust

I am an Executor of my Mom's estate with a will. I am also one of two distributees. She was a beneficiary of a perpetual trust that was set up 80 years ago. There are funds left, but they aren't supposed to be disbursed for another 20 years after her death, which appears to be an impossible undertaking. Problems are that noone was named to manage the assets and preserve their value during the 20 years. Besides, many of the future legitees have vanished or left no kin. Besides, no-one was named to continue administering this trust.

What is the best way to modify or break the trust, so that assets are preserved and distributed while they still have value?

Re: Modifying a trust

You need to contact an attorney to discuss your matter further. I presume that your mother has recently passed. Other facts are unknown.

Key to your matter are the trust and will. These documents should be reviewed by an attorney.

Trustee succession may apply to your situation. Contact me should your require assistance with the probate of the estate.
