Legal Question in Wills and Trusts in Maryland

Money given to daughter before death

For the past 7 months my grandfather was living with my parents and i. He just passed away a couple of weeks ago. during the time he was with us, he did give my mother some money to help with the bills and also to pay for some of the lost wages for her quiting her job to stay at home and take care of him. Her sister's name was on my grandfathers bank account. Now her sister's lawyer wants to see receipts. there was a total of 12,000 dollars given to my mother and we have paperwork showing that about 4,000 went directly to his personal expences. Do they have any right to queston money given to a daughter by her father before his death?

Re: Money given to daughter before death

Normally, any pre-death gifts are outside the estate court's authority to modify, unless there is evidence of coercion or duress (undue influence) or outright theft (e.g., your mother forging your grandfather's name on checks). There could be tax consequences if the money to your mother exceeded $10,000, so the documentation that $4,000 was spend on the GF is critical. If your aunt has filed against your mother, she will need assistance to defend. Please contact us for more information. Thank you. Adele Abrams. www.aabramslaw.com.
