What is the process for probate?

My father died and he lived in Maryland. He was not married. He has three children, I am one of them. I reside in California, by the way. He did not have a will. He lived by himself, and owes no money on the property and estate in Maryland. Does the state of Maryland put his estate up for sale?? And when it sells, how long will it take unitl I get my portion of the inheritance since I am an heir?

One of you must petition the probate court in the county in MD where he lived for an administration of the estate. Once the assets are collected and debts paid, then the administrator can distribute the remaining assets.

You need to open an estates in MAryland. The process of settling the estate can be rapid if done properly.
