Legal Question in Real Estate Law in Massachusetts

Does the owner have to be out the house by the closing date?

I recently sold my house and I was told that I have to be moved out before the closing date. I recieved information that I was misinformed and I'm not supposed to leave the property empty. If I do so I will be held responsible for damages, if any. My main question for you is Do I have to vacate the premises before or after the closing date?

The standard purchase and sale agreement requires the seller to deliver the property vacant. This means you need to be out before the closing. The buyer will also want to perform their walkthrough after you have vacated. You should review your purchase and sale agreement to confirm this. There are situations where a seller remains in the property post closing, however the parties would have to agree upon this and the seller typically pays the Buyer a use/occupancy fee to remain post closing.
