Legal Question in Administrative Law in Massachusetts

FID Card Ma.

Greetings, I was wondering if you could help me out. I had a laps of judgment 7 months ago. I was accused of Larceny over 2 counts and one count of Destruction of Pvt Prop. The Dest.Pvt.Prop was DISM during Pre-trial, how ever the 2 Larceny over’s stuck and I was given 6 months of Administrative Probation (CWOF). I paid no Fines just fees, never had blood drawn or finger prints done.

I know a CWOF is not a conviction, but after the 6 months is up the D.A. said “you wont live with this for the rest of your life.” I also know that at the end of CWOF the charges get DISM. I know that’s how they will read on a BOP or a CORI.

My Question. Since I was given my 2ed chance I decided to make something of my self, so I got into Security. Im doing well in it and was offered a new position but it requires my to have a FID card so I can have OC (mace). I understand that MA is very stringent upon issuing FIDs to people with backgrounds. Can they by law deny me my Constutional rights?

Re: FID Card Ma.

The short answer is yes... Massachusetts reserves the right to deny you your 2nd Amendment Rights by not granting you a Firearms ID Card if they do not think you are a "suitable person." If you are denied, you have the right to file a lawsuit to challenge the denial, however, there is a time limit to appeal.
