Re: Foreclosure Bankruptcy

In Bankruptcy you can keep a house if you continue to make payments otherwise known as reaffirmation. Most consumers use Chapter 7 if they qualify and are current on mortgage payments. If you are not current on payments then Chapter 13 would be your only choice to keep the house. It is important if you have any equity to have a homestead, generally these forms/instructions are available on line at your local registry of deeds in your county as you would want to take advantage of the protection it gives you in Bankruptcy as an exemption. The filing fee is $35.00 for the homestead at this present time. Need any more information please contact me.

No one can accurately answer that question without more information from you. To get the best answer you can rely on, an attorney will need to know (1) your income and expenses; (2) your mortgage payment(s) amount(s); (3) how long you have owned your home; (4) and whether there are any other facts or circumstances that prevent you from keeping your home in bankruptcy OR prevent you from filing bankruptcy at all.

Pull this information together and meet with a lawyer. Feel free to call or visit my site and read my blog at www.mcleodlawoffices.com.
