consideration

if I retain a tax person to do my taxes and because I am recieving money back that I did not expect I tell the tax preparer I will give him another 400.00 when I get my refund for doing such a good job, but then I have a falling out w/ him and I dont pay him the additional bonus 400.00 can the tax preparer sue for the money

Did you offer the money before or after he had prepared your taxes?

If you offered it after the tax preparer had already finished your taxes, then you were simply simply contemplating a future gift as a thank you.

You mention "consideration" in your question. As you may have anticipated, his acceptance of your offer to give him an extra $400.00 does not create an enforceable contract because consideration is lacking.
